Terms of Service

These terms govern your use of Pawsby, a desktop application operated by a sole trader based in Victoria, Australia (ABN 81 914 923 253). By using Pawsby, you agree to these terms.

1. Minimum age

Pawsby is intended for users aged 16 and over. We do not knowingly offer the service to anyone under 16, and there is no option for parental consent on their behalf. If you believe a user under 16 is using Pawsby, contact us and we'll take appropriate action.

2. The service

Pawsby is a desktop companion app featuring an animated pet, AI chat, calendar reminders, and optional cloud sync. Some features are free; others require a paid subscription.

3. Subscriptions & billing

• Subscriptions are billed on a recurring basis (monthly, unless stated otherwise) through Creem, our payment processor and merchant of record.
• You can cancel anytime from Settings. Cancelling stops future billing — you keep access to your paid plan for the remainder of the period you've already paid for.
• We do not offer refunds for partial billing periods. This does not limit any consumer guarantee you're entitled to under the Australian Consumer Law, which cannot be excluded by these terms.
• Prices may change with notice; continued use after a price change means you accept the new price.

4. Bring Your Own Key (BYOK)

If you provide your own AI provider API key, you are responsible for all usage costs charged by that provider. Pawsby is not responsible for charges, rate limits, or content returned by third-party AI providers you connect directly.

5. Acceptable use

You agree not to:

• Use Pawsby for anything illegal, or to generate content that harasses, exploits, or endangers others — especially minors
• Attempt to reverse-engineer, decompile, or extract the AI models or backend systems Pawsby connects to
• Abuse rate limits, share subscription access beyond the device limit for your plan, or resell access to Pawsby
• Use the calendar or sync features to store or transmit content that violates someone else's rights

6. AI-generated content

Pawsby's pet chat is powered by third-party AI models. Responses are generated automatically and may be inaccurate, incomplete, or inappropriate at times. Don't rely on Pawsby for medical, legal, financial, or safety-critical advice.

7. Your content

You own your chat messages and any custom pet content you create. By using optional Cloud Sync, you allow us to store an encrypted copy so it can sync across your devices — we cannot read its contents.

8. Termination

You can stop using Pawsby and delete your account anytime at pawsby.app/delete-account. We may suspend or terminate access for violations of these terms, including abuse of the service or non-payment.

9. Disclaimers & liability

Pawsby is provided "as is," without warranties of any kind beyond those that cannot be excluded under the Australian Consumer Law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service.

10. Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes will be handled in the courts of Victoria, Australia, without prejudice to any consumer rights you may have under the Australian Consumer Law.

11. Changes to these terms

If we make material changes, subscribers will be notified by email, and all users will see a notice in the app. The "Last updated" date above always reflects the most current version.
